The appeal of Robert F. Ford on behalf of Morgan Day, owner, to appeal the cited code violations of the Uniform Dwelling code section, SPS 321.06 as referenced by section 16.01(6)(b) of the City of Waukesha Building Code. The existing home was built in 1925 therefore the owner is permitted to appeal the requirements as allowed by section 16.17 of the Waukesha Building code. The provisions of the code are not believed to cover the question of the existing headroom height that was permitted by the code in effect at the time of construction. If granted this appeal would allow headroom height in the existing building at 518 Brasted Pl. to vary from the headroom requirements of the Uniform Dwelling Code for new construction.
